Important Contractor-Matching Notice
Wayzata Windows is not a contractor or installer. Independent contractors are responsible for project evaluations, measurements, estimates, pricing, licensing, insurance, permits, products, warranties, scheduling, installation methods, employees or subcontractors, and workmanship. Any construction agreement is between the property owner and the contractor selected by the property owner.
1. Acceptance of Terms
These Terms and Conditions govern your access to and use of wayzatawindows.com and the services made available through the website. By accessing the website, submitting a form, or otherwise using the site, you agree to these Terms and Conditions and the Privacy Policy.
If you do not agree to these terms, do not use the website or submit information through it.
2. About Wayzata Windows
Wayzata Windows is an independent contractor-matching and informational service. Wayzata Windows is not a window contractor, door contractor, installer, remodeling contractor, construction company, manufacturer, dealer, franchise, or provider of construction services.
Wayzata Windows does not directly perform window replacement, door replacement, installation, inspections, repairs, construction, remodeling, measurements, permitting, or warranty work.
3. Contractor-Matching Service
Wayzata Windows may use information you provide to identify independent third-party contractors that may serve your geographic area or project type. Contractor matching is based on available information, service areas, project criteria, and contractor availability.
Submitting a request does not guarantee that a contractor will be available, that a particular number of contractors will respond, that estimates will be provided, or that any contractor will accept the project.
You are not required to hire any contractor identified or introduced through Wayzata Windows.
4. Independent Contractor Relationship
Contractors identified through Wayzata Windows are independent third parties. They are not employees, agents, representatives, partners, joint venturers, franchisees, or subcontractors of Wayzata Windows.
Wayzata Windows does not supervise, direct, control, employ, or manage independent contractors and does not control their pricing, recommendations, scope, scheduling, products, installation methods, employees, subcontractors, business practices, warranties, or workmanship.
Any agreement for construction, installation, products, services, financing, warranties, or related work is solely between you and the contractor or other third party you choose to engage.
5. Contractor Qualifications and Due Diligence
You are responsible for independently evaluating any contractor before hiring. This may include reviewing licensing, insurance, registrations, references, complaint history, written estimates, product information, warranties, permits, contracts, financing terms, and other qualifications relevant to your project.
Wayzata Windows does not represent or guarantee that a contractor is qualified, licensed, insured, available, suitable, or legally authorized for every project or jurisdiction. Contractor qualifications and legal requirements may vary.
6. Estimates, Pricing, and Project Information
Any estimate, quote, recommendation, scope, product selection, schedule, financing term, warranty, or pricing information is provided by the independent contractor or other third party, not by Wayzata Windows.
Project costs and recommendations can change after measurements, property evaluation, discovery of concealed conditions, product selection, permit requirements, structural conditions, material availability, or changes requested by the property owner.
Website content is general informational material and should not be treated as a project-specific estimate, engineering opinion, architectural advice, code determination, or guarantee of product or installation performance.
7. Permits, Codes, and Compliance
Independent contractors are responsible for determining and performing their own obligations regarding permits, licensing, code compliance, safety requirements, manufacturer instructions, inspections, and other project-specific legal or technical requirements.
Property owners should confirm responsibilities for permits and approvals in the written agreement with the contractor. Wayzata Windows does not issue permits, perform inspections, or certify code compliance.
8. Website Information and No Professional Advice
Wayzata Windows provides educational information about window replacement, door replacement, materials, styles, glass, Minnesota weather considerations, condensation, scenic openings, Lake Minnetonka-area homes, and related topics.
Information on the website is provided for general educational purposes and may not reflect the specific conditions of your property, current product specifications, local requirements, or the advice of a qualified contractor or other professional.
You should rely on project-specific evaluations and written documentation from qualified professionals before making construction or purchasing decisions.
9. Communications Consent
If you provide a phone number, email address, or other contact information and consent to communications, Wayzata Windows or an independent contractor may contact you about your inquiry or project request, subject to the consent you provide and applicable law.
Where applicable, calls or text messages may be made using automated technology. Message and data rates may apply. Consent to marketing communications is not a condition of purchasing services from an independent contractor.
You may opt out of marketing text messages by replying STOP where supported. Additional information about data practices is available in the Privacy Policy.
10. User Responsibilities and Acceptable Use
You agree to provide accurate information and to use the website only for lawful purposes.
You may not use the website to submit fraudulent, false, misleading, abusive, unlawful, harassing, infringing, malicious, or unauthorized content; interfere with website operation or security; attempt to gain unauthorized access; introduce malware or harmful code; scrape or harvest information in violation of law or these terms; impersonate another person; or use the site in a manner that could damage Wayzata Windows or third parties.
11. Intellectual Property
Unless otherwise stated, the website design, text, graphics, branding, organization, original content, and other materials made available through Wayzata Windows are owned by or licensed to Wayzata Windows and are protected by applicable intellectual property laws.
You may use the website for personal, non-commercial informational purposes. You may not reproduce, republish, distribute, modify, create derivative works from, sell, license, or commercially exploit protected site content without appropriate permission, except as permitted by law.
Third-party trademarks, product names, manufacturer names, and other third-party intellectual property remain the property of their respective owners. References to third-party brands do not by themselves imply endorsement, partnership, dealer status, certification, or affiliation.
12. Third-Party Websites, Products, and Services
The website may link to third-party websites, mention products or manufacturers, or facilitate contact with independent contractors. Wayzata Windows does not control third-party websites, products, services, privacy practices, contracts, warranties, financing, or business practices.
Your interactions with third parties are governed by the terms, policies, and agreements applicable to those third parties.
13. No Endorsement or Manufacturer Affiliation
References to window or door materials, manufacturers, product categories, technologies, or brand names are for informational purposes unless expressly stated otherwise.
Wayzata Windows does not claim to be an authorized dealer, certified installer, preferred contractor, exclusive partner, or endorsed representative of a manufacturer or contractor merely because that company, material, or product is discussed on the website.
14. No Warranties by Wayzata Windows
To the fullest extent permitted by applicable law, the website and contractor-matching service are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise.
Wayzata Windows does not warrant or guarantee contractor availability, contractor qualifications, estimates, prices, schedules, products, financing, workmanship, warranties, project outcomes, energy savings, comfort improvements, condensation reduction, code compliance, or the accuracy or completeness of third-party information.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Wayzata Windows will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the website, contractor matching, communications with contractors, third-party products or services, or construction agreements.
To the fullest extent permitted by applicable law, Wayzata Windows is not responsible for acts or omissions of independent contractors or other third parties, including pricing, recommendations, scheduling, property damage, personal injury, delays, defects, warranty disputes, financing issues, code violations, permit issues, or workmanship.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
16. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Wayzata Windows and its owners, affiliates, service providers, personnel, and representatives from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, information or content you submit, or your infringement of third-party rights.
This provision does not require indemnification for conduct that cannot lawfully be shifted to you.
17. Privacy
Your use of the website is also subject to the Wayzata Windows Privacy Policy, which describes how information may be collected, used, shared, retained, and managed.
You can review the Privacy Policy for additional information.
18. Electronic Communications and Records
By using the website and submitting information electronically, you consent to receiving website-related notices and records electronically when permitted by law.
You are responsible for maintaining current contact information and for retaining copies of contractor estimates, contracts, warranties, disclosures, and other project records that are important to you.
19. Changes to the Website or Service
Wayzata Windows may modify, suspend, restrict, or discontinue portions of the website or contractor-matching service at any time, subject to applicable law.
Site content, service areas, project categories, forms, contractor availability, and other website features may change without prior notice.
20. Changes to These Terms
These Terms and Conditions may be updated from time to time. The “Last updated” date on this page may be revised when changes are posted.
Your continued use of the website after revised Terms are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
21. Governing Law and Venue
These Terms are intended to be governed by applicable federal law and, to the extent state law applies, the laws of the State of Minnesota, without regard to conflict-of-law principles.
Any mandatory rights or venue protections that apply to you under applicable law remain unaffected. Nothing in these Terms is intended to waive rights that cannot legally be waived.
22. Severability and No Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
A failure by Wayzata Windows to enforce a provision of these Terms does not waive the right to enforce that provision or any other provision later.
23. Entire Agreement
These Terms and Conditions, together with the Privacy Policy and any additional notices or consent language presented when you submit information, constitute the agreement governing your use of the website and contractor-matching service.
These website Terms do not replace or modify any separate contract you may enter into directly with an independent contractor.
